PIP Legislation Would Limit Powers of Secretary of State

Representatives Denis Márquez and Adriana Gutiérrez of the Partido Independentista Puertorriqueño (PIP) have introduced a bill to define the functions that can be delegated by the Executive and those that are non-transferable, in response to concerns over the broad powers granted to Secretary of State Francisco Domenech by Governor Jenniffer González through an executive order. The bill, Proyecto de la Cámara 1333, aims to repeal the Law for Faculties to the Governor to Delegate Certain Functions and Duties (Ley 104 de 1956) and replace it with a new statute to limit the concentration of power in non-confirmed officials.

The PIP legislators argue that the current mechanism of executive orders has led to a gradual concentration of powers in the Secretary of State and other executive-appointed positions, allowing for control over appointments, public contracts, personnel movements, and operational supervision of agencies. The bill seeks to restrict these powers and prevent conflicts of interest.
