In Puerto Rico, a new judge in the Guayama Court is considering a request from Elvia Cabrera Rivera’s defense team for a second trial, citing new evidence that was not available during the first trial. Cabrera Rivera was convicted of the murder of 16-year-old Gabriela Nicole Pratts Rosario in August 2025 in Aibonito. The defense claims that new information from an interview with Cabrera Rivera’s daughter and co-defendant, Anthonieska Avilés Cabrera, exonerates Cabrera Rivera and points to another person as the one who provided the murder weapon.
The prosecution has been granted access to the presentence report to evaluate the defense’s claims and will have 15 days to present its position. The case has drawn widespread attention in Puerto Rico, and the new developments come after the defense presented a motion requesting a new trial based on the new evidence. The motion argues that the new information, including a description of the murder weapon as a pink razor with a blade, was not available during the first trial and could have changed the outcome.
The prosecution will now review the presentence report and present its position on the request for a new trial.
