House Bill Proposes Canceling NFEnergía Gas Contracts Over Supply Failures in Puerto Rico

  • Representative José Aponte Hernández filed House Joint Resolution 428 to order PREPA, the Public-Private Partnerships Authority and the Ports Authority to begin canceling NFEnergía’s gas supply and pier A and B contracts.
  • The resolution cites a July 2025 LNG ship delivery interruption and delays attributed to the AMUR RIVER vessel, diesel reliance and costs that can pass to consumers through rate adjustments.
  • The bill alleges NFEnergía operated the Puerto Nuevo piers without completing federal authorizations including FERC’s, and would end its exclusive use of piers A and B; the company denies holding a monopoly there.

Why this matters: NFEnergía’s LNG feeds San Juan power plant units 5 and 6, so contract cancellation would reshape the fuel supply behind the island’s grid and the rate adjustments households pay when gas deliveries fail and diesel is substituted.

A joint resolution filed in Puerto Rico’s House of Representatives would order government entities to immediately begin canceling NFEnergía’s contracts for natural gas supply and for exclusive use of Piers A and B in the Puerto Nuevo port sector, in San Juan Bay. House Joint Resolution 428, by Representative José Aponte Hernández, is directed at the Puerto Rico Electric Power Authority (PREPA (AEE), or PREPA), the Public-Private Partnerships Authority (AAPP) and the Ports Authority (AP).

It also provides for claiming damages and eliminating the exclusivity of the piers. The measure comes as the company cannot guarantee the arrival of a new gas ship to fuel Units 5 and 6 of the San Juan Power Plant. Its statement of motives cites recurring failures to deliver liquefied natural gas (LNG), which it says forced reliance on costlier alternate fuels such as diesel.

It cites a July 2025 incident in which entry to port of an LNG vessel was interrupted, delaying delivery, and another episode last month with delays of several weeks, attributed to a larger vessel than agreed (the AMUR RIVER), failure to deliver documents required by a court, and disputes over interpreting an Energy Bureau resolution. The document says these stemmed from NFEnergía’s decisions or foreseeable circumstances, and that the extra costs fall on public finances and could reach consumers through rate adjustments.

It says NFEnergía holds exclusivity over the piers through a Ports Authority contract; the company denies having a monopoly there. The proposal also alleges operations began without completing authorization from federal regulators, including the Federal Energy Regulatory Commission (FERC).
