Puerto Rico Governor Jenniffer González Colón has ordered a lawsuit against NFEnergía LLC (NFE), a subsidiary of New Fortress Energy Inc., to enforce contractual provisions that allow for an alternative natural gas supply through a tolling agreement. The contract, signed on December 4, 2025, stipulates that if NFE fails to deliver gas or invokes a force majeure situation, it must enter into tolling agreements.
This mechanism enables the Puerto Rico Electric Power Authority (AEE) to procure natural gas from an alternative supplier using NFE's terminal in San Juan. Since September 16, 2026, NFE has not supplied natural gas to units 5 and 6 of the San Juan Central power plant, which have been operating on diesel, a more expensive fuel.
The AEE activated the contractual provision on September 22, but NFE has refused to proceed with the established mechanism. The lawsuit, to be filed in the US District Court for the District of Puerto Rico, seeks to compel NFE to confirm the availability of its terminal, designate a representative, provide protocols for receiving ships, and refrain from taking actions that impede the entry and reception of natural gas supplied by a third party.
