At a glance

  • The Department of Justice may not have sufficient evidence to file additional charges in the case.
  • The court has denied a request for reconsideration regarding access to the case’s presentation report.
  • The defense may request a new trial if new testimony is found that favors Cabrera Rivera.

Why this matters: The case’s development affects the family of Gabriela Nicole Pratts Rosario and the community’s trust in the justice system, particularly in cases of violent crime.

Former prosecutor Ernie Cabán stated that the Department of Justice will not file additional charges against other individuals in relation to the killing of Gabriela Nicole Pratts Rosario. Despite Secretary Lourdes Gómez Torres’ previous assertions that more accusations would be made, Cabán believes that without sufficient evidence and testimony, the case cannot proceed. He noted that the young man who was injured in the incident refused to testify about who inflicted his wounds.

Cabán also mentioned that there were issues related to the theft of a vehicle and possible illegal appropriation of property, but without witnesses or scientific evidence, the case cannot be presented in court. Additionally, Cabán explained that the court has denied a request for reconsideration regarding access to the case’s presentation report for both the press and the defense of Cabrera Rivera.

However, if new testimony is found that favors Cabrera Rivera, the defense may request a new trial.
