Notes the jury sent to federal judge Pedro A. Delgado Hernández during deliberations in the second trial of former Puerto Rico Aqueduct and Sewer Authority (AAA) vice president Ivonne M. Falcón Nieves are now in the case’s electronic file. The file holds at least seven notes, at least three from Thursday, October 8, the day of deliberations.
At 11:56 AM the jury asked for an English-Spanish dictionary; the judge replied the court could not provide one. At 1:04 PM it asked whether the McKinsey report was public to contractors or only for AAA internal use; the judge told jurors to rely on their collective memory. At 3:40 PM it wrote, 'We have reached a verdict.'
The jury found Falcón Nieves guilty on counts 6 and 7, conspiracy and electronic fraud of honest services. The court then polled jurors individually. Prosecutors had no objection to her remaining free on her current conditions, and the judge granted the defense’s request to keep her on bail.
Sentencing is set for January 15, 2027, at 1:30 PM in Hato Rey. She was charged in December 2015 with her sister Marielis Falcón Nieves, other officials and former Popular Democratic Party fundraiser Anaudi Hernández, who pleaded guilty and became a cooperating witness. The First Circuit in Boston overturned her earlier 41-month sentence in August 2023, ruling the sisters should be tried separately.
