DACO and Retailers Renew Holiday-Season Agreement on Consumer Complaints in Puerto Rico

Why this matters: During the holiday shopping season, consumers at Puerto Rico stores can invoke the DACO-ACDET pact to demand rain checks, substitute items or price matches when advertised deals sell out.

The Puerto Rico Consumer Affairs Department (DACO) and the Puerto Rico Retail Trade Association (ACDET) renewed their collaboration agreement for the holiday shopping season, in effect from November 6, 2026 to January 6, 2027. The memorandum of understanding was signed on Friday by DACO interim secretary Erwin Álvarez Rodríguez and ACDET president José Luis González Suárez, marking the tenth anniversary of the formalized alliance.

Under the agreement, when advertised sale items run out and the guaranteed minimum time applies, consumers may request a substitute item or a rain check. Other options include applying a discount equal to the original offer’s savings to another product, or obtaining the advertised item at the promotional price or lower, with free home delivery or later in-store pickup.

For online purchases, promotions may be subject to inventory availability, and when limits or available quantities are announced, the guaranteed minimum time for physical stores applies. The pact also covers disclosing per-customer item limits, guidance on high-demand product availability, staff training, protocols for line management and store security, and communication channels between store managers and DACO for handling complaints.

The renewal comes as retail sales reached $4.41 billion in July 2026, up 1.1% from the same month a year earlier, according to a Department of Economic Development and Commerce report published September 23.
