The Bayamón court ruled temporarily not processable, meaning unfit to face the legal process, the 16-year-old Elvin W. Reyes Rosa, accused of killing his grandmother and attempting to kill his half-brother, as well as violating the Weapons Law, in events reported on September 26 at the Santa María Shopping Center in Guaynabo. Defense lawyer Carlos Soto Laracuente explained that the defense invoked the minor’s unfitness to be processed, so the case did not follow the automatic process as in other instances; it is a legal determination made by a judge, not a medical one.
According to the lawyer, the youth had no prior diagnosis, but in the processability evaluation professionals in human behavior, and a defense expert, established that at the time of the charges the minor could not understand the proceedings, comprehend the consequences, recognize the role of the judge, contribute to his defense, or argue coherently; there are temporary and permanent forms of this finding. The court set a hearing to reevaluate the minor’s capacity within 30 to 60 days, as the judge determines, so that proceedings can continue once he leaves his current state.
