LUMA Energy Files Counterclaim Against Puerto Rico Government

LUMA Energy presented a counterclaim against the Puerto Rico government in the San Juan Tribunal, alleging that the administration of Governor Jenniffer González is using its power illegally to fulfill a campaign promise, disregarding the consequences for the people of Puerto Rico. LUMA claims the government is acting in bad faith and against its own decisions, citing the extension of the supplemental contract granted in 2022.

The company argues that canceling the agreement would cost the people at least $4,500 million in damages and operational costs. LUMA faces two lawsuits, one from the Authority for Public-Private Partnerships (AAPP) and the Puerto Rico Electric Power Authority (AEE), and another from the governor.

The company had sought to move the cases to the federal court, but a panel in Boston denied the request, leaving the cases to be decided in Puerto Rico's courts. LUMA warns that terminating the contract would cause chaos and compromise the operation of the electrical system, putting access to federal funds at risk.
